PRIVACY POLICY

This Privacy Policy (hereinafter referred to as the “Policy”) governs the relationship in the field of protection of personal data of visitors to the website https://missionfoundation.in.ua (hereinafter referred to as the “Website”), which belongs to the CHARITY ORGANISATION “CHARITY FOUNDATION “MISSION OF FREEDOM” (USREOU code: 45365718, location: Ukraine, 07401, Kyiv Oblast, Brovary District, Brovary, Heroiv Krut Street, Building 16, Apartment 46, registered in accordance with the current legislation of Ukraine (hereinafter referred to as the “Foundation”).

1.GENERAL PROVISIONS

1.1. In this Policy, the following terms shall have the following meanings:

  • Personal database means a named set of ordered personal data in electronic form and/or in the form of personal data files;

  • Consent of the data subject means a voluntary expression of will by an individual (subject to his or her awareness) to grant permission to process his or her personal data in accordance with the stated purpose of the processing, expressed in a form that allows the conclusion to be drawn that consent has been given.;

  • Processing of personal data means any action or set of actions such as collection, registration, accumulation, storage, adaptation, modification, updating, use and dissemination (distribution, sale, transfer), depersonalisation, destruction of personal data, including with the use of (automated) information systems;

  • Personal data means information or a set of information relating to an identified or identifiable individual;

  • Personal data subject means an individual whose personal data are processed;

  • Third party means any person other than the personal data subject, the controller or the owner of the personal data;

  • Cookies means small text files that are stored in the browser of a device (computer, mobile phone, etc.) after a visit to the website and that the website sends to the browser. All other terms used in this Policy shall have the meaning given to them by the legislation in force in Ukraine, including international legal acts ratified in Ukraine.

1.2. The purpose of this Policy is to inform personal data subjects of the procedure for processing their personal data when visiting/using the website, as well as to ensure the protection of their personal data during such processing.

1.3. This Policy, as well as the activities of the Foundation in relation to the collection, processing, storage and other lawful actions regarding personal data, are governed by:

  • The Constitution of Ukraine;
  • The Law of Ukraine “On Protection of Personal Data” No. 2287-VI of 01.06.2010;
  • Other applicable laws and regulations of Ukraine on personal data protection;
  • International legal acts ratified by Ukraine. Legal relations arising in the Foundation in connection with the processing of personal data of residents of foreign jurisdictions are also subject to the law (including international law), national and international regulations on the protection of personal data of residents of such countries.

1.4. The Foundation is the owner of the personal data processed in connection with the visit/use of the website options. The Foundation has the right to entrust the processing of personal data, in whole or in part, to third parties on the basis of an agreement concluded in accordance with the requirements of the applicable law.

1.5. An individual is a personal data subject for the purposes of this Policy if he or she is a visitor to the Website, including if he or she uses any of the options available on the Website.

1.6. The Foundation guarantees that:

  • It complies with good practice and legal requirements for the protection of personal data;

  • It protects the rights of personal data subjects;

  • It prevents the risk of security breaches in the processing of personal data.

1.7. The purpose of the processing of personal data obtained through the website is to carry out the statutory activities of the Foundation.

1.8. The placement of this Policy in the link referred to in clause 4.1. of this Policy is intended to inform the data subjects about the Owner, the composition and content of the personal data collected in connection with the visit/use of the Website, the rights of the data subjects, the purpose of the collection of their personal data and the third parties to whom such personal data may be communicated.

2. PERSONAL DATA PROCESSING

2.1. The Foundation may collect and process the following information about you:

  • Information you provide to the Foundation: this is information about you that you provide by: using the Website and the Website options, subscribing to receive updates by email, providing charitable assistance (donation) through the Website options, communicating with the Foundation through the options available on the Website, etc;

  • Information about you collected by the Website and other systems:

1) When you visit the Website, third parties may collect certain information about you and your visit, such as the type and version of your browser and the pages on the Website that you visit, your Internet Protocol (IP) address;

2) The Website may also download cookies to your device;

3) If you contact Foundation staff via the website or other electronic communication means.

  • Information collected by third parties about you on the Website through your actions: this is information about you that you provide to third parties (e.g. Facebook, Google, Twitter) using the social media sharing options available on the Website, when you navigate from one page to another or when you view materials that are linked (opened) to other platforms (websites).

2.2. How the Foundation processes your personal information will depend on how you use and interact with the Website. Some of the information may be provided directly by you when using the Website or otherwise; other information may be collected and processed independently by the Foundation using automated technologies used on the Website.

2.3. Legal grounds for data processing: When you visit the Website, the Foundation will process your personal data if 1) the Foundation has obtained your consent to such processing, 2) your personal data is necessary for the Foundation to enter into and perform a transaction with you or to take steps prior to the conclusion of a transaction, 3) in cases where the Foundation has a legitimate interest in processing your personal data and this legitimate interest does not override your interest in data protection or your fundamental rights and freedoms, and 4) in other cases determined by applicable law.

In some cases, the Foundation may be required by law to process your personal data or will process your personal data for the establishment, exercise or defence of legal claims.

2.4. Automated processing mechanisms: The Foundation and third parties may use automated information processing technologies to process information in certain sections of the Website. The Foundation uses cookies to store content and preferences that allow the Foundation to process standard information that your browser sends to certain websites you visit, such as your IP address, browser type and language, as well as the referring website, the pages you visit and the links you click on the Website. The availability of this technical information helps the Foundation to improve the Website.

2.5. The Foundation may use your personal data only for the purposes and to the extent permitted by this Policy and applicable law, including (but not limited to) 1) to process your request (appeal) to the Foundation via the Website, 2) to ensure that you provide charitable assistance (donation) using the options available on the Website, 3) to carry out other statutory purposes of the Foundation in accordance with the procedure set out in applicable law.

2.6. The Foundation may collect personal data processed during your visit/use of the Website, including by entering such data into a personal database. Your personal data will be stored in accordance with the requirements of current legislation on personal data.

2.7. Your personal data will only be disclosed with your consent or in cases specified in this policy and applicable law.

2.8. The Foundation may publish some of the user data on its website in the Reporting, Receipts section.

2.9. Your personal data will be deleted or destroyed in the event of:

  • Expiry of the 2-year retention period or any other period established by applicable law;

  • Termination of the legal relationship between the data subject and the Foundation, unless otherwise provided by law;

  • In other cases determined by the legislation in force on the protection of personal data.

2.10. The Foundation does not process personal data concerning racial or ethnic origin, political, religious or philosophical beliefs, membership of political parties or trade unions, criminal convictions, or data concerning health, sex life, biometric or genetic data, except in the cases provided for by law.

3. RIGHTS OF THE PERSONAL DATA SUBJECTS

3.1. When visiting/using the Website, you have the right:

  • To receive from the Foundation information not specified in this Policy regarding the processing, the conditions of access to your personal data, or to give a corresponding order to receive such information through your authorised persons, except in the cases specified by law;

  • To have free access to your personal data;

  • To receive a response to a request for the processing of your personal data in the manner and within the period provided for by applicable law;

  • To submit a reasoned request to object to the processing of your personal data or to have your personal data amended or destroyed if it is processed unlawfully or is unreliable;

  • To protect your personal data against unlawful processing, accidental loss, destruction, damage caused by intentional concealment, failure to provide or untimely provision of your personal data, as well as to protect against the provision of information that is inaccurate or discreditable to the honour, dignity and business reputation of an individual;

3.2. You have the right to raise any issues relating to the collection, use, storage and other processing of your personal data with the Human Rights Commissioner of the Ukrainian Parliament, who can be contacted at [email protected]. 4. CHANGES TO THE PRIVACY POLICY
